Abstract

Insurance practices often experience differences with written laws and regulations because in the world of insurance, practice habits, especially those written in standard insurance contracts. This study aims to determine the provisions of the application of subrogation rights at PT. Asuransi Wahana Tata Yogyakarta. Knowing the resolution of the factors that hinder the application of the principle of subrogation in the event of a claim at PT. Asuransi Wahana Tata Yogyakarta. The problems examined in this paper are (1) how is the application of the principle of subrogation in an insurance agreement at PT. Asuransi Wahana Tata Yogyakarta, (2) how to solve the factors that hamper the application of the principle of subrogation. This study uses empirical research methods, namely by collecting data through in-depth interviews with companies about the facts, then an analysis is carried out with reference to the relevant regulations. However, although the provisions regarding subrogation are in accordance with the prevailing laws and regulations the implementation of subrogation is not running as it should, the Insured does not clearly understand the subrogation and its regulations. The insured also does not provide complete supporting data about the third party.
