Abstract
Banking is one of the instruments which have a strategic role in order to maintain continuity of economic development and producement of funds. The Bank functions in the distribution of funds is to provide various types of credit. Bank as a business firms always expect the amount of loans can be returned smoothly and make profits because agreement of the credit that provided to customers is not without risk, so one of the application is to secure bank loans distribution by requiring collateral and placed the liability rights. UUHT is a tool or a guarantor of laws to the creditor if the use of credit have a bad credit/ credits crush. If the creditor injured the promise (wanprestasi), the first liability rights object with their own authorithy (parate execution) by auction through the State Property Service and Auction Office (KPKNL). If there is a resistance from the debtor, the implementation of the auction is determined, that based on Executorial Title contained in the Certificate of Liability Rights. Liability Rights Object sold through the public auction according by the procedures that specified in the regulations of laws. The procedure is taken through the help of the District Court (PN) using the fiat court execution.
