Abstract

This study aims to determine the sanctions for chemical castration in Law Number 17 of 2016 violate human rights in Indonesia. This type of research is normative legal research. The primary legal materials used include (1) Law No. 23 of 2002 concerning Child Protection; (2) Law 17 of 2016 concerning Stipulation of Government Regulations in Lieu of Law No.1 of 2016 concerning Child Protection; and (3) Law Number 39 of 1999 concerning Human Rights. Meanwhile, secondary legal materials are obtained through books, papers, research results, journals, internet, documents and newspapers. Based on the discussion on the suitability of chemical castration sanctions in Law Number 17 of 2016 in the study of Human Rights (HAM) in Indonesia, it can be concluded that the criminal sanctions for chemical castration do not violate human rights because the sanctions are legal in nature where those who can be punished are the perpetrators. who meet the qualifications to be sentenced to chemical castration and not all perpetrators of sexual violence can be sentenced to chemical castration. Meanwhile, human rights in Indonesia are unlimited human rights. Of course, the chemical castration law cannot be the only solution to solve the problem of sexual violence crimes. There needs to be awareness and cooperation between the community and the government to find the root of the problem and the right treatment to deal with crimes of sexual violence.
