Abstract

Copyright is the exclusive right of an author that arises automatically based on a declarative principle after a work is manifested in a tangible form which is detailed into 19 groups of works, one of which is a song and / or music work. Copyright consists of moral rights and economic rights. The essence of economic rights lies in royalties. Royalties are awards for creations in economic value collected from users of songs and / music works. However, in collecting royalties, creators have limited abilities so that another party called the Collective Management Institute (LMK) is needed which plays a role in managing all creator royalty matters. Seeing the potential for collecting royalties to be inefficient and there will be overlapping royalty payments. So, the government formed the National Collective Management Institute (LMKN) as a government aid agency that plays a role in managing all the interests of the creator's economic rights. This legal writing is empirical with the formulation of the problem, namely, how is the role of LMKN in protecting copyright, especially the economic rights of song and / or music creators and what are the obstacles and obstacles in carrying out its role. Based on the results of the analysis of this legal writing, the authors conclude that the LMKN plays a role in withdrawing, collecting and distributing royalties for songwriters in coordination with LMK based on digital data and the big obstacle is in the function of collecting royalties
