Abstract

Indonesia is a country rich in natural resources. One of the natural resources owned by the Indonesian state is in the mining sector. However, in managing these resources, they often do not care about the environment. Massive exploitation carried out with large tools to get maximum results often damages the infrastructure around the mining environment. The problem in this research is how to control environmental damage due to sand mining and what obstacles are faced in implementing environmental damage control. This research is an empirical legal research. Damage control efforts have been made by PT. Jogo Adik by carrying out mining activities in an area designated as a Mining Area in the Regional Regulation. As well as receiving supervision from the Environmental Service in the implementation of mining activities. There are several obstacles in efforts to control environmental damage due to mining activities. Some of these obstacles include the limitation and indecisiveness of the Environmental Service in imposing sanctions on mining business actors who violate it. Another obstacle is that there are two conflicts of interest in efforts to control environmental damage and the social life of the community around the mine who make mining activities their main livelihood.
