Abstract

There were three research problem addressed in the research which are (1) Is the authority of the central government to carry out closure of level crossings under Janti fly over in accordance with the applicable laws and regulations? (2) Is the local government authorized in government affairs in the field of train transport? (3) what is the solution that can be offered in solving this problem? the purpose of this study is to find out whether the closure of level crossing by the central government is in accordance with existing legislation, find out whether local governments have authority in train transport affairs and find solutions that can be offered in resolving these problems. The research method used by the author is a normative method by comparing rules with one another. The results of this study are that the central government in closing the level crossing is in accordance with existing legislation,however the closing was not accompanied by the issuance of KTUN, that the regional government also has authority in railroad matters but in this case only certain types of trains that only operate in their area, the solution that can be offered in this problem is that Janti community can make a lawsuit against the law by the government because the closure is not in accordance with the principles of good governance.
