Abstract

Exposure to advertisement/promotion of cigarettes in various online media, one of which YouTube is increasing and influencing children to smoke. This certainly affects the health behaviors of children and the fulfillment of children's rights during their growth and development. This study aims to determine the legal protection of children as victims of cigarette advertising through YouTube social media. This study uses a normative legal research method, which focuses on statutory regulations so that the thought process is used deductively. The results of this study indicate that the government has so far not been able to provide any action to provide legal protection for children as victims of cigarette advertisements through YouTube social media in the form of controlling exposure to cigarette advertisements due to a legal vacuum. Thus, the government must immediately formulate the provisions of cigarette advertising through online media in the Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions providing legal protection and legal certainty for children as victims cigarette advertising through YouTube social media.
