Abstract

This study was conducted to reveal the basis of judge’s judgment in making a decision for heritance case in Karonese Society in the District Court of Kabanjahe with the decision number 29/Pdt.G/2014/PN.KBJ. The method used is normative research with case study approach that focuses on the basis of the judge’s judgment in making a decision for heritance case in Karonese society in the District Court of Kabanjahe. The finding reveals that the basis of the judge’s judgment in making a decision for heritance case in Karonese society in the District Court of Kabanjahe are the positive law and the number of jurispredence number 179, 1961. Based on this decision, the sons and daughters have a same position as the heir, so that the judge decide that the heritage in the form of a land is divided equally for the sons and daughters.
