Abstract
Legal memorandum is formal, polish, and comprehensive written to answer legal question of the problematic obligation of the biological parents to the neglect of the child. The writing of this legal memorandum is based on normative legal research with the search for legislation, conceptual approaches and case approaches. Problematic obligation of biological parents to the neglect of children, based on Indonesian law especially Law number 1 of 1974 on Marriage and Law Number 35 of 2014 on changes to Law Number 23 of 2002 on Child protection in order to fulfill the child’s rights and achieve legal certainty, parental obligation to the child is parenting, nurturing, educating, and protecting the child. Families to the third degree can take over responsibility when the parents is unable to fulfill his or her obligations to the child. The government has a responsibility in preventing the neglect of children by the parents by conducting appropriate legislative and administrative efforts. Thus the rights of the child as mandated in the Constitution of the Republic of Indonesia year 1945 with reference to the convention of the Right of the Child can be fulfilled.
