Abstract

The Industry activity in Kabupaten Brebes (Regency of Brebes), in fact still has challenge with Dumping and Industrial Waste Management that potentially effect Environmental Stability and Pollution. Criminal Sanction will be on the top choice compared to Civil and Administrative Law. Therefore, we need clear direction and regulation with regards to the implementation of Criminal Sanction for suspect of B3 Waste in Environmental Pollution. The goal for this writing is to have a better understanding on Regulation of Criminal Sanction for the suspect in B3 Waste Environmental Pollution In Kabupaten Brebes, followed with what challenge that has been faced together with solution. Research Method used by the writer is a normative writing that focused on the Law. The result of this research is that the Criminal Sanction to the suspect of B3 Waste Pollution as it is regulated by the Law No. 32 of 2009 concerning Environmental Protection and Management. However, the implementation of the sanction is relatively ineffective compared to the accused action. Finally, We need a firmed action and legal certainty by the Government regarding the limitation of classified action with affect resulted, where can referenced to Government Law No. 101 of 2014 concerning Hazardous and Toxic Waste Management.
