Abstract

Public transportation is an important service. It is needed by the community in their daily activity. During the Covid-19 pandemic, according to Surat Edaran Gugus Tugas Percepatan Penanganan Covid-19, consumers are required to show a Covid-19 free letter through the results of a rapid test or PCR to use public transportation. The government has indeed set the highest rapid test cost of Rp. 150,000, but for poor consumers the fare is burdensome. This study aims to identify and conduct legal studies related to government policies in protecting poor consumers to get rapid test services in order to access public services and facilities. The type of the research is normative legal research. The research use literature study method by examining legal materials, both primary and secondary, for then descriptive analysis and legal synchronization were carried out. The results of this study indicate that for the poor, or poor consumers, the cost of the rapid test is not borne by BPJS nor given subsidies / assistance from the government. It can lead to discrimination where only wealthy people can access public transportation. Therefore, government affirmative action is needed towards the poor, or poor consumers, in terms of financing the Covid-19 rapid test and PCR test. Thus, discrimination can be avoided and the fulfillment of rights to health, right to life, and economic, social and cultural rights can go hand in hand.
