Abstract

Assimilation is a process of coaching prisoners which is carried out by integrating prisoners into people's lives. In general, assimilation is carried out if a convict with good behavior is proven not to have served a disciplinary sentence in the last six months, is active in participating in a good training program, and has served 1/2 (one and a half) of his sentence. With the dynamic nature of the law, there are differences in the application of assimilation rules during the Coronavirus Disease 2019 pandemic. In the Coronavirus Disease 2019 pandemic assimilation of prisoners is carried out by returning prisoners to their respective homes with some strict rules and must be obeyed by prisoners. This study uses legal normative research methods. The data used are sourced from primary and secondary legal sources and interviews. The thought process is used deductively in this research. The results show the importance of this step being taken to break the chain of the spread of Coronavirus Disease 2019 with the issuance of the Keputusan Menteri Hukum dan HAM nomor M.HH-19.PK/01.04.04 Tentang Pengeluaran dan Pembebasan Narapidana dan Anak Melalui Asimilasi dan Integrasi dalam Rangka Pencegahan dan Penanggulangan Penyebaran COVID-19 using the guidelines for the Regulation of the Peraturan Menteri Hukum Dan Hak Asasi Manusia Republik Indonesia Nomor 10 Tahun 2020 Tentang Syarat Pemberian Asimilasi Dan Hak Integrasi Bagi Narapidana Dan Anak Dalam Rangka Pencegahan Dan Penanggulangan Penyebaran Covid-19. Many positive impacts that have been felt from this policy, people's fear of accepting prisoners have proven not to occur. Based on existing data, Indonesia still has a low recidivist rate compared to other countries.
