Abstract

Equality for persons with disabilities who have the same rights and opportunities as normal people in all aspects of life and livelihood, including being equal before the law, without discrimination, and receiving equal legal protection and benefits as stated in the CTRPD (Convention on The Rights of Person with Disabilities). A witness is a person who can provide information for the purposes of investigation, prosecution and trial regarding a criminal case which he has heard himself, he has seen and experienced himself. Judges in the trial process have the authority to determine the testimony of witnesses with disabilities who are legally competent or incompetent based on information from a doctor or psychologist, not solely because they have limitations or disabilities. Law enforcement officials must understand and be sensitive to the limitations and obstacles that witnesses with disabilities have. In the process of examining witnesses, judges may order the examination process separately, to ensure protection and a sense of security for witnesses with disabilities in providing testimony. Courts can also cooperate with competent community social institutions in providing assistance to witnesses with disabilities to be able to assist these witnesses in providing testimony information required in the judicial process.
