Abstract

It is interesting to discuss General Principles of Good Government (AAUPB) in European tradition when compared to the principles of Christian morals proposed by Thomas Aquinas. According to the European Community Treaty (1957), there are four main principles mentioned in European general principle of good government: equality, fundamental rights, legal certainty, and proportionality. Meanwhile, Thomas Aquinas had also stated some significant principles of justice, namely; fundamental rights, equality, and justice. It suggested the preliminary hypothesis that European general principles of good government are close to the idea of Christian moral principles by Thomas Aquinas. Starting from this preliminary hypothesis, this research investigates the meeting point between European General Principles of Good Government and Christian moral principles as envisioned by Thomas Aquinas. Therefore, this research is not about history nor the influence of those two principles, but about comparing the two value devices. The comparison study helped to find the relation of those two categories of principle. The writer broke down the result of the research into some points. Firstly,the four main principles in European general principle of good government: equality, fundamental rights, legal certainty, and proportionality have similarity with the idea of Christian moral principles by Thomas Aquinas. Second, these two principles put the protection of rights as the main principle. Third, in the christian moral principles, Thomas Aquinas regulated the basic things, while the General Principles of Good Government went into more detail. Fourth, both European general principles of good government and Christian moral principles try to follow the development of society.
