Abstract

The title of this study is the criminal liability of drugs dealers without a permit based on the head of the medication and food control agency number 24 of 2017 concerning the criteria and procedures for drug registration. This study describes and learns about criminal liability towards drug dealers without a permit that deviates from the regulation head of the drugs and food control agency number 24 of 2017. This research is a research with normative research methods. The data used is in the form of primary data in the form of legislation and is supported by secondary data consisting of legal opinions and principles of legal facts. Data collection techniques used in this study are deductive thinking methods. The results of this study indicate that the criminal liability of medication dealers without permission is to use Law number 36 of 2009 regarding health in article 196 can be in the criminal law no longer than 10 (ten) years and a maximum fine of Rp 1,000,000,000.00 (one billion rupiahs) ) and article 197 can be sentenced to a maximum imprisonment of 15 (fifteen) years and a maximum fine of Rp 1,500,000,000.00 (one billion five hundred million rupiah), which refers to article 98 of Law number 36 of 2009 concerning Health.
