Abstract

The title of this research is the Role of Local Government in Supervision of Groundwater Utilization by Mall Business Activities in Yogyakarta. Businesses who running mall business need sufficient water to run their business, such as sufficient groundwater to run the mall operations. Supervision is required in the use of groundwater so that violations don’t occur that can harm the community and the environment. It is set in Article 39 paragraph (3) letter c of Yogyakarta Special Region Regulation Number 5 of 2012 about Groundwater Management. The purpose of this research is to determine the role, constraints, and solutions of local governments in monitoring groundwater use in mall business activities in YogyakartaThis study uses an empirical method that focuses on facts in the field; the data used are primary data supported by secondary data. Data obtained from respondents and resource persons will be analyzed qualitatively. This research is expected to provide benefits for the development of legal science regarding the use of groundwater for mall business activities in Yogyakarta. This research uses an empirical method that focuses on social facts in the field. Data used are primary data supported by secondary data. Data obtained from respondents and resource persons will be analyzed qualitatively.The conclusion obtained from this research is the role of the Regional Government in supervising the use of groundwater by mall business activities in Yogyakarta through the Yogyakarta Licensing and Investment Service, Yogyakarta PUP-ESDM Service and Yogyakarta-Bantul BP3ESDM. As for the constraints faced by the Yogyakarta Government in monitoring the use of groundwater by mall business activities is there is no permission from the mall businesses in making wells, the lack of the number of workers in BP3ESDM in monitoring the use of groundwater by the mall, and the change of mall personnel who don’t understand the regulations of groundwater use. The solution of these constraints is the local government needs to be firm in enforcing regulations regarding the use of groundwater by malls businesses.
