Abstract
Human Trafficking is form of crime against human rights which is still hard to eradicated until this time and becomes one of worldwide issues. Generally, everyone could becomes a victim of human trafficking, however the most coveted by offenders are young women and children. The victims do not just suffered physically but also psychological and economic loss as a result of human trafficking. Therefore in order to protect and fulfill the rights of victims, restitution needs to be provided by the offender to the victim or victim’s family. Restitution is a form of legal protection for victim in order to get payment for material and immaterial damages that charged to the offender as a result of the crimes committed. This research aims to determine and analyze the form of restitution regulations that could provide justice for victims of human trafficking. The research finds that by applying restorative justice provides both victims and offenders with more benefits and satisfaction than did retributive justice. The offenders could be held responsible for what they have done directly to the victims, it could reduces crime victims’ post-traumatic stress symptoms, payment of the related costs, reduces crime victims’ desire for violent revenge against their offenders and forgiven for the offenders is possible.
