Abstract

The purpose of this research is to find out wheter gambling in the wuat wai tradition of the Papang customary law community fulfills the elements of gambling crime or not based on statutory regulations and to find out the efforts of law enforcement officials, especially the police in handling gambling in the wuat wai tradition in the Papang customary law community. The type of research in this research is empirical legal research that focuses on social fact. In this study, the social fact is that there is gambling in the wuat wai tradition by the Papang customary law community. The source of data used in this research is primary data as main data and secondary data as supporting data. Data collection methods, primary data by interviews respondents and observation, secondary data by using literature study. The conclusion of this research is that gambling in the wuat wai tradition fulfills the element as a gambling crime and the police do not handle gambling in the wuat wai tradition in the Papang customary lay community because they respect local tradition.
