Abstract

This research is titled "Implementation of Changed Agricultural Land Function to Non Agricultural Land For Residence After in effect of regional regulation No 4, 2006, Concerning Plan of Space Order of Klaten Regency. This research is based on the need of local government policy related with the Changed Agricultural land Function into Non agricultural Land, either preventive or repressive way in order to limit the use of agricultural land for building houses uncontrollably. The change of agricultural land function is chosen for this research because nowadays, the use of the land conducted by both individuals and private companies do not agree with the local regulation about Plan of Space Order No. 4, year of 2006 in Regency of Klaten. This research took the residence as the choice of research because this regency repeatedly performs the development of housing due to the rate of economy and the increase of population growth. Therefore there are many housing built in the agricultural areas. The problem responded in this research is if the implementation of the changed agricultural land function has agreed with the local regulation No. 4, 2004 about Plan of space order in Regency of Klaten. This research is conducted by juridical normative approach, that is analyzing the matter according to the law/ act in - effect. It is considered that the cases exposed are the regulation and norm, that is the local regulation No 4, 2004, about Plan of space order in Regency of Klaten. Collecting data was carried out by interviewing the key persons as the source of information. Furthermore data are analyzed using qualitative descriptive method, that was, translating data and concluding them to find out weather or not the research carried out by writer agreed with the local regulation. Based on the result, both literature and field research as well as analysis and discussion that has been conducted shows that the implementation of changed agricultural land use to non-agricultural one for housing after in effect of the local regulation of Regency Klaten, especially in Trunuh village, South Klaten district has greatly changed the agricultural area function into housing area fimction. It is caused by uncleanly controlling and monitoring as well as coordinating among related instances. In addition there is a chance for investor to develop the housing in the region. Although there are a local regulation and Governor instruction of West Java that limits the expansion of agricultural area into housing area, in fact the implementation does not agree with area proportion and area plan.
