Abstract

God creates human being as His figure and performance, so they are prestigious creature. Based on the above fact, there are two problem formulations in this legal writing or thesis, namely: (1) How is Catholic Church's view on Human Right and the enforcement in Indonesia based on Social Doctrine of Catholic Church? (2) How is the Implementation of Human Rights enforcement in Indonesia based on Human Rights Enforcement Law No.26, 2000? Therefore the objective of the research was to obtain data concerning Catholic Church's view on Human Right and the enforcement in Indonesia based on Social Doctrine of Catholic Church. It was to contribute for the process of beside jurisprudence development especially in Human Right field. Then, it can give clear understanding in the effort to enact a legal rule by considering equal treatment for Human Right enforcement in Indonesia. Research method used in this legal writing was normative legal one, including research that studies the ongoing norms either in special or in general, literature material, and positive legal norms such as regulations viewed to Human Rights in this matter studied from Social Doctrine of Catholic Church perspective and Human Rights Enforcement Law No.26, 2000, conducted by literature study. The results of the research revealed the following conclusions: (1) Church's involvement in Human Rights problems happened through a long process. History of church proved that Church had ever rejected and challenged Human Rights, but after the Second World War Church gradually experienced involvement and change of views on Human Right. Church's position changed totally from challenging to defending Human Rights. (2) Normatively, Indonesia has had high commitment on Human Right, it seems in national legal regulation or international instrument ratification on Human Rights, but implementation of Human Rights enforcement in Indonesia should be increased. Therefore, the researcher gives suggestions that honor on Human Rights should be struggled, then the Church should participate and cooperate with government in giving protection on Human Rights by giving input for each democratic governmental system and advocacy should be established in field of legislative policy as well as in treating witnesses and victims.
