Abstract

The title of this research paper is "Criminal Law Perspective in the Application of Article 27 Paragraph (1) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) on the Phenomenon of Sex Chat on Social Media. ". The problem discussed in this paper is to see and analyze the perspective of criminal law in the application and implementation of the Law on Information and Electronic Transactions on the phenomenon of sex chat on social media. The research method used in this writing is normative legal research. The data used are primary data, secondary data and tertiary data. The data was collected by means of literature study and then analyzed by using qualitative methods. Based on the literature research conducted, the researcher found that based on the perspective of criminal law, there are several provisions that can be implemented and used to “capture” sex chat offenders who commit immoral offenses in accordance with the provisions of Article 27 paragraph (1) of the ITE Law. A person who violates the provisions of Article 27 paragraph (1) of the ITE Law can be charged and charged with the provisions of Article 281 paragraph (1) and Article 282 paragraph (1) of the Criminal Code.
