Abstract

The writing of this law is entitled Implementation Of Force Majeure Clauses In Renting Contract Of Renting Co-Working Space By A Startup Company In The Suuth Jakarta Region At The Pandemic Period After The Legalised Of Rules On PSBB. As a result uf this rufe, the tenant cannot occupy the pface be is renting as he should, but he is still obliged to pay the rent for the place. Therefore, because of this, there is a problem about fairness for the parties to the contract after the pandemic and the issuance of rules regardi ng PSBB. In the force majeure clause in the agreement it is stated that a pandemic is a Force majeure, but in another clafZ se of the agreement if is stated that the furce majeure that occurred did not occur immediately eliminates the obligations of the parties. The COVID-19 pandemic is a force majeure that is included in a relative force majeure, which means that the situation will one day disappear and the agreement can be re-implemented. The expected implementation uf the force majeure clause from the tenant is the exemption of rental fees while the fessor feels that he has implemented the cfause by giving a discount, this is based on the fact that the lessee continues to use non-physical facilities during the PSBB period
