Abstract

Advocate is one legal upholder apparatus which has very important role. In a jurisdiction process, beside as the legal advisor of the perpetrator of criminal action, the Advocate also could functions as the attendant of victims in the case of physical violation toward the children. This protection is related with the psychological protection of the children. This research aimed to know what extent to the role of an advocated is needed to the victim in handling the case of physical violation toward the children. This research is normative research, it means the research more focused on the enforcement of positive legal norms by the form of legislations. The primary data source in this research is secondary data by the shape of books and the opinion of the expert in legal field. Primary legal source in this research was gained from the result of interview by the source persons. Mentod of analysis which is used in this research is qualitative analysis method and the process of drawing conclusion by deductive reasoning method. This research taken conclusion that the role of advocate toward the children as the victims of physical violation has function, and the method of handling which more specific compared to the handling of criminal action in general. Legal attendant toward the children as victims, as has been ruled in the Law Number 18 of 2003 is granted without any charge, by considering that most of the victims' family come from low level of economical society and low level of education. The barriers which are faced in the efforts to give any attendant toward the children as the victims of violation is the behaviour of the victim which tends to isolation themselves. The advice could be submitted by the author is in order the advocate could cooperate with the other legal upholder apparatus to protect the children as the victims of violation. In addition, the advocate and the other legal upholder apparatus are hoped to be able to give more socialization on the presence of fee legal attendant.
