Abstract

The advancement of information technology in cellular phone which should bring any positive impact toward the society life, however in its development even be misused by the people who have no responsibility to conduct the criminal action. One of them is the deception which uses cellular phone. In the constitution of Indonesia, deception is based on laws where in article 378, but for technology crimes not in based on laws. The purpose of this research was to know what extend to the effort of the police in revealing the deception through the cellular phone which in 2000s often happened. The method of research used was normative, i.e. by concluding the data which present in the legislation, books which related with the case which has aimed to get the theoretical framework concerns on the case which will be studied, any by using method of qualitative deductive analysis, i.e. the process of thinking which used deductively, i.e. from the general proposition which the fact has been known (believed) and ended in a conclusion (new knowledge) which has specific characteristic. The result of this research was the police just conduct its duty till the steps of investigation whereas on the researching steps, the police have not been able to conduct its duty as well according to the society's hope. The advice to the part of police was the police should increase the human resources he have, especially in the field of information technology, either in increasing the quality of personal of police or even the medium and premedium of the police in conducting its duty as the investigator and researcher.
