Abstract

The title of this legal writing is Juridical Review of Diversion in the Case of Bullying (Bullying) Committed by Children. This law writing analyzes the importance of diversion is in solving bullying cases commited by children. In Indonesia, bullying cases often occur from year to year. Settlement through diversion in bullying cases by law enforcement officials is not always the main thing to do. Therefore the purpose of this paper is to find out arguments that need to put forward a way of diveri in solving cases of bullying committed by children. This research is normative legal research supported by primary and secondary data. Primary data is obtained from interviews, while secondary data is obtained from laws and regulations, internet, journals, and legal facts. After the primary and secondary data are analyzed, conclusions can be drawn with the deductive thinking method, namely the process of thinking from general propositions which are in fact known and ends in a specific conclusion. Based on the results of the research and discussion that the author has made, it can be concluded that, juridical reviews of cases of bullying committed by children have been regulated in Law No. 11 of 2012 concerning the Juvenile Criminal Justice System is part of a juridical reform that prioritizes the children interests. The important reasons of prioritizing diversion in solving bullying cases committed by children are: children do not need to be detained, avoid being stigmatized or labeled as criminals, keep children away from negative influences and implications of the judicial process, make children become responsible, and diversion is being carried out because it priorit the welfare of the child.
