Abstract

The study entitled Judge’s Consideration in Deciding Rule Out The Provision Expired Prosecution of Corruption (Case Study Decision Number: 545 K/Pid.Sus/2013). Corruption which is an extraordinary crime requires special arrangements for the expiration of prosecution because there is no regulation regarding the expiration date of prosecution, so it refers to Article 78 KUHP. The formulation of the problem from this research is how is the consideration of judges in implementing expired prosecution in corruption cases and how expired implication rule out expiration of prosecution in corruption. This legal writing is using normative research methods that takes data sources from secondary data consisting of primary legal material in the form of legislation, court decisions, and secondary legal material in the form of literature, research results. The conclusion from this legal writing is the writer finds judge in his consideration used the provisions of The United Nations Convention Against Corruption (UNCAC) to rule out the expired prosecution in corruption cases. The United Nations Convention Against Corruption (UNCAC) is considered effective and enforces legal certainty in eradicating corruption
