Abstract
This Legal Memorandum, with title "The Rights Of Children From Mixed Marriage Towards Land Inheritance From Australian Citizen Father" discuss and analyse about inheritance as main problem with a background from different nation that cause dual citizenship. Problematic issues came from foreign marriages, that different nation adapt different right, such as jus soli and jus sanguinis that can be acquired by the nationality or ethnicity of one or both of the parents. This thesis is arranged in the form of legal memorandum with the following systematics: the background of the problem, the position case, the checking of related documents, then continued with the theoretical basis, legal opinions, and closed by the conclusions and suggestions. Indonesia, with a legal system of civil law, adopting jus sanguinis as the right for citizenship, meanwhile Australia, adopting jus soli with requirements, obviously will cause an important issues, such as inheritance of the child, and the property on another land. Primary data was obtained from positive law. Secondary data consist of legal opinions obtained from literature studies. The results showed that the children from mixed marriage should register their birth to Australian embassy to get the right to choose their own citizenship after turning 18 years old.
