Abstract

Corruption has caused huge losses to the state which could have an impact on the emergence of crises in various fields. In order to avoid the occurrence of state financial losses due to corruption, there is a system of asset recovery through criminal compensation payments. However, asset recovery through this instrument is still not optimal due to the small amount of compensation paid by the convicted due to insufficient assets. The purpose of this research is to find out how to recover state financial losses when the criminal compensation payment is insufficient in the criminal act of corruption. The type of research used as a method is normative legal research with secondary data sources consisting of primary legal materials, namely statutory regulations and secondary legal materials, namely legal opinions from books, journals, and research results. The result of this research is that asset recovery can be carried out by the State Attorney Law through civil asset forfeiture after the verdict inkracht and compensation is insufficient. A lawsuit can be filed against the convict or his heirs if in court the defendant cannot prove that the property he obtained was not from a criminal act of corruption.
