Abstract

Society not only as an object in the medical service but also as a subject in it. It is closely related with the basic right of human being. In order to support that, informed consent is needed in every medical action. The purpose of this research is to know whether every medical action related with informed consent in the medical service always has criminal responsibility. Relating with that case the research method use is normative law research which focuses on norm and is supported by secondary data as the primary data, such as law regulation relating with the research and literature or books which are relate with the problem . the data use in the research is the secondary data consisted of primary law and secondary law material. This research also uses literary study by using the normative data collecting and also informan, dr Rino Rudiono. Analytic method use is qualitative analysis and deductive thought method. The result of this research is if the mistake occurs in the medical service related with informed consent, the doctor has to responsible to the deed which causes the patient undergoes indecrepency and death. It can be mentioned as abusement. The doctor can do the medical service without the informed consent if done in the emergency condition. To avoid this case, the doctor is observed in every medical action done. The action should be fitted with the medical standard and there is informed consent in the action. It is aimed to protect the patient's rights so that the can be gained properly.
