Abstract

This research aimed to know the effort was conducted by the patient to ask the responsibility of dentist for his negligence, i.e. from the result of this research is conducted laboratory test or by taking photo (roentgen) by the recommendation of related dentist to further examination in hospital, whether it was the dentist's negligence or the reaction of the medicine or the other factors. Then the matters that could be functioned as verifying materials in order the dentist's negligence could be justified are the procedures of operational standard that available. If the dentists do not conduct it, thus he had trespass his professional promise and if the negligence that happened caused the patient become body handicap or dead, thus this matter could be happened by the current law by the submitting of accusation to the court with the available procedures. The type of this research is normative legal research used secondary data sources as the secondary data i.e. the law regulation related to this research and literature or some books related with the case understudied, and also used primary data i.e. data gathered directly from those part become the object of case understudied. Meanwhile the data analysis used quantitative analysis by used method of descriptive in drawing conclusion. From the result of this completed research, the steps that be conducted by the patient who feel harmed because of the dentist's negligence in asking legal responsibility is by report him to the hospital medical committee to investigate this case. Furthermore, medical committee follows up this case to the police, who will conduct inspection toward the dentist that perceived had conducted negligence. Beside the mattes that become the verifying material in order his negligence could be justified is the presents of medical record, informed consent, medical standards and witness.
