Abstract

This watchfulness aim analysis criminal responsibility system on doing an injustice in the field of traffic and road transport, and to detect applications responbillity according to criminal on traffic accident doing an injustice and road transport. Method approaches that used in this watchfulness approaches legislation, that is criminal code; number law 8 year 1981 about procedure of criminal; number law 22 year 2009 about traffic and road transport. This watchfulness characteristics descriptife in primary law ingredient and secondary law ingredient, gatherred by book study and analyzed with law analysis. Criminal responsibility without there error that is with existence subjek law besides the person (human). that is road administrator. in rule section 7 verse (1) uu no. 22 year 2009, traffic exertion and road transport in direct service activity to society is done by government, local government, corporate body, and/or society. thereby, follow economical author in the event of a doing an injustice as determined in paragraph 273 uu no. 22 year 2009, so side that can the responsibility according to criminal (subject) criminal that is central government or local government, corporate body, and/or society. in criminal law theory, criminal responsibility system without this error existence is with system vicarious liability. criminal that dropped fine criminal.
