Abstract

This study is entitled the implementation of the provisions of overtime wages for workers at PT Artawa Indonesia Gresik (case study decision No 809/K.PDT.SUS-PHI/2015 Gresik Industrial Relation Court). This study aims to find out how the implementation of the payment of overtime wages for workers of PT Artawa Indonesia in Gresik based on the decision and to find out how the implementation of the payment of overtime wage provisions for PT Artawa Indonesia workers after the existence of the decision. This type of research is an empirical legal research, conducted on social facts to obtain primary data and supported by secondary data. This research was conducted in Gresik Regency. The results showed that PT Artawa refused to pay the overtime wages because there was no overtime warrant. But, there was an habit in the company to carry out over time without an overtime warrant. The decision of this case has not been completed implemented because theres no process of execution yet. Secondly, the author found that there is still a violation of overtime payment after the decision but no report has been submitted to the labor department.
