Abstract

Discrimination can be understood as behavior that limits, harasses or diminishes the enjoyment and exercise of rights so that the person cannot get his full rights. Discriminative behavior often targets certain groups, one of which is people with disabilities. Discrimination can occur in persons with disabilities in various aspects, including aspects of obtaining employment. The emergence of Article 53 paragraph (1) of the Law on Persons with Disabilities in conjunction with Article 65 of the Law on the State Civil Apparatus provides a 'fresh air' for persons with disabilities in finding work and joining in government. This study discusses the implementation of Article 53 paragraph (1) of the Law on Persons with Disabilities in the recruitment of civil servants within the Yogyakarta city government. The purpose of this study was to determine the implementation of article 53 paragraph (1) of the law on persons with disabilities as well as to find out the constraints in the recruitment of civil servants in the city of Yogyakarta. The results of the study found that the city of Yogyakarta has not fully implemented a two percent quota for persons with disabilities to become civil servants, and the obstacles encountered for examples such as facilities and infrastructure for selection, harassment and community thinking about the requirements for physical and spiritual health.
