Abstract

The title of this research is “GRANTING OF LAND PROPERTY FOR OWN HOUSE OF 3rd CLASS OF GOVERNMENT EMPLOYEES IN PROVIDING OF LEGAL CERTAINTY BASED ON DECREE OF THE MINISTER OF AGRARIAN / HEAD OF NATIONAL LAND AGENCY NUMBER II OF 1998 IN SORONG, WEST PAPUA” A house is one of important things in life as for government employee, it is not only for shelter but to develop life in healthy, save, harmonious and orderly environment. Granting of land property for 3rd class of government employees made possible for ten years serving government empoyees who already obtain occupancy permit and have not buy a house or acquire own facilities and/or land yet. In acquisition of land for owned house of 3rd class government employees, there are several steps to do such as own land and house pay off, obtain the decree of Department of Public Work which is a house ownership confirmation , apply the registration of land property rights to the Agrarian Office in Sorong, pay administrative costs according to Deposit Warrant of The Head of Agrarian Office and obtain confirmation decree of recognition of home and land ownership. In this research, we can conclude that granting of land property for 3rd class of government employeeswho have been provided their legal certainty based on decree of Minister of Agrarian/ Head of National Land Agency number II of 1998 in Sorong, West Papua is not in providing of legal certainty yet. There are 32 respondents or about 58, 2% who not already apply the registration of land property rights forhave not payadministrative costs already beside only 23 respondents or 41,8% have pay off the own house and land, apply the registration of land property rights and obtain certificate of ownership already.
