Abstract

This research intended to find out who is responsible by law for children who are involved in narcotics distribution and to find out how the application of the principle that the best interests of children involved in narcotics distribution. The method used was normative research, i.e. legal research by conducting abstraction through deduction process of positive legal norms by shape of legal systematization and legal synchronizing vertically and horizontally, conducted description, systematization, analysis, interpretation, and evaluate positive law to the problems concerning on Best Interest Principle for Children Involved in Narcotics Distributions. According to the Child Protection Act No. 23 of 2002, the State Gazette Number 109 of 2002, children must be protected her rights as a victim of drug distribution so that the parties should be subject to criminal sanctions are those that involve children in drug distribution Based on the principle of "lex specialis derogat legi generali" Child Protection Act No. 23 of 2002 on Child Protection, the State Gazette Number 109 of 2002 is used to solve problems related to children. Best Interest Principle for Children Involved in Narcotics Distributions has not been fully implemented in accordance with Child Protection Act No. 23 of 2002, the State Gazette Number 109 of 2002, as limited to the process (formal legal) such as provision of a special department dealing with children in law enforcement; system of closed hearings for cases of children and consider the verdict a child's future.
