Abstract

Witnesses and victims have a very important role in every criminal case because often the testimony of witnesses and victims can influence or even determine the tandency of judges to decide on criminal cases, but in reality the position of witnesses and victims is still very vulnerable to terror and intimidation, and is unprotected by law so that witnesses and victims are reluctant to give their testimony because their public position can actually place themselves as a “victim for the second time” because they reveal what they have seen, heard or experienced. Law number 31 of 2014 concerning amandments to law number 13 of 2006 concerning witness and victim protection regulates form of protection for witnesses and victims with LPSK as the institution with the authority to provide protection. The purpose of this research is to find out the form of regulation in law number 31 of 2014 concerning the protection of witnesses and victims in anticipation of threat in the criminal justice process.
