Abstract

Legal research is about Break Time and Wage Protection to the Shopkeepers in Origin Merch, Sleman, Yogyakarta, which practically has many irrelevances to the applicable laws and regulations. The problems formulation from this legal research is How is Break Time and Wage for The Shopkeepers in Origin Merch, Sleman, Yogyakarta. The aims of this research is the ability to know the break time and wage protection to the shopkeepers about the implementation, which is not applicable with the rules. The type of study used in this law research is empirical law research is empirical law research. The primary source of this research is from the respondens by interview. Secondary data for this research including the laws and professionals’ books. The conclusion of this study is that practically there is an irrelevance to article 79 verse 2A Statute No.13 Year 2003 about Employment that is no break time after 4 (four) hour work, then the irrelevance to the Provincial Minimum Wages in Yogyakarta year 2010 which is Rp.754.694 according to Governor’s Decree No.217/KEP/2009. Suggestion from this legal research is that the owner and the shopkeepers learn about the applicable laws and regulations, especially about the break time and wages. Both the owner and the shopkeepers should know their own rights and duty so there is no irrelevance to the applicable laws. In the end, there is no detriment for both the owner and the shopkeepers in their relation in workplace.
