Abstract
The problem of this thesis research was about the fulfilment of the Indonesian legislation on the rights of children of former ISIS members. Those children who are forced to live in refugee camps still require protection for their survival. However, their rights to protection are not being met due to the lack of a regulation governing the return of former ISIS members. The problem of this research was studied by normative legal research. The data were collected by library research. Based on data analysis, it can be determined that Indonesian regulations aim at protecting children's rights are in conflict with the International Law and Indonesian regulations. Only children under the age of ten are being considered for repatriation by the Indonesian government
