Abstract

Narcotics are substances or drugs originating from plants or non-plants, both synthetic and semi-synthetic, which can cause a decrease or change in consciousness, loss of taste, reduce to disappearance of pain, and can cause dependence which is divided into groups. The purpose of this study is to find out and analyze the basic considerations of the Judge in prosecuting children who are perpetrators of narcotics abuse of marijuana and to find out and analyze the obstacles experienced by Judges in setting demands on criminal cases of narcotics narcotics, especially children. The method used in this research is normative research, focusing on the facts of legal norms and social norms. The conclusion of this research is that the decision of the Judge in cases of criminal acts of narcotics abuse is not always the same, the basis for consideration of the Judge in making decisions against perpetrators of narcotics abuse is from various aspects, namely juridical and non-juridical aspects, the Judge's obstacle in making decisions for victims of narcotics abuse is the pandemic condition that complicates the trial process. Suggestions from the research are expected by law enforcement officers The law can arrest all perpetrators of narcotics abuse crimes especially for dealers, it is hoped that the Judge who decides the case especially for the case of narcotics abuse, it is better to prepare other alternatives that can help the trial run in a pandemic condition
