Abstract

The thesis examines of the Criminalization of Unauthorized Absenteeism by Members of the Indonesian National Armed Forces. This unauthorized absence by members of the military may result in military service if carried out continuously. Absence without permission in military service have something in common, namely both absent from duty, but there is a difference between the two types of crime, namely, desertion is the permanent absence of a soldier or commonly called leaving military service without permission. This absence without permission by a member or soldier of the TNI for an unspecified time is usually carried out for different reasons, such as those who do so for reasons of economic factors, circumstances that make it impossible to attend, or deliberately running away from duties and responsibilities. The effectiveness of the criminalization of absenteeism without permission also needs to be reviewed because considering that in military service there are military disciplinary laws and military criminal laws, so whether this absence without permission needs to be criminalized considering that there are rules regarding desertion. Supervision and review of the rules regarding in order to create true soldiers who are obedient and adhere to the oath of soldiers and the Sapta Marga.
