Abstract

Emergence of Perma No. 4 of 2020 concerning Administration and Trial of Criminal Cases in Courts Electronically, resulting in a shift in the concepts and principles in the KUHAP including regarding the trial forum through electronic media, the presence of the Defendant/witness and the evidentiary process is not carried out face-to-face, thus affecting the implementation of the trial process and the quality of evidence is based on the principle of due process of law, namely technical issues, infrastructure, readiness of human resources, cyber security, and problems related to coordination between agencies. The formulation of the problem is how to prove in handling criminal cases based on Perma No. 4 of 2020 concerning Administration and Trial of Criminal Cases in Courts Electronically and what are the obstacles in proving the handling of criminal cases based on Perma No. 4 of 2020 concerning Administration and Trial of Criminal Cases in Courts Electronically . The type of research conducted is normative legal research. The results of the research conducted by the author are that the handling of criminal cases through electronic trials is a modern judicial concept by adhering to the principles of fast, simple and low cost. However, the Panel of Judges, Public Prosecutors and Legal Advisors had difficulties in examining valid evidence when the trial was conducted electronically, because access using the internet network was unstable and did not meet face-to-face in the courtroom. The obstacles are different standard operating procedures at each agency, the available budget, the quality of human resources and inadequate infrastructure are factors that hinder the trial process, especially in terms of proving criminal cases.
