Abstract
The purpose of this research is to find out the implementation of the prudential principle by the Surakarta Land Office. The research method used in this research is normative juridical collectingdata using literature studies, and books or documents related to the problem under study. The results of the study stated that the prudential principle basically must be implemented by every land office in the issuance of land certificates, this because before the land certificate can be issued it must be registered first.According to article 32 of Government Regulation 24 of 1997 concerning Land Registration, a certificate is a proof of rights that is valid as a strong means of proof regarding the physical data and juridical data contained in it, as long as the physical data and juridical data are in accordance with the data contained in the document. Therefore, the application of the preduntial principle in the issuance of land rights certificates is very important to maintain and support the quality of land service work. The implementation of this principles in the issuance of landcertificates by the Surakarta Land Office can be seen from the initial process when all the requirements submitted by the applicant are accepted until the end when the land title certificate is issued. In practice, the Surakarta Land Office applies the prudential principle by paying attention to and complying with procedures and stages so that the process can run well until the end. The procedure itself is a procedure that refers to the regulation of the Minister of Agrarian Affairs, Head of BPN Number 3 of 1997 concerning the Implementation of Government Regulation Number 24 of 1997 concerning Land Registration. All requirements received by the Surakarta Land Office, before being submitted to the leadership, must pass various checks. This is done to facilitate the process and minimize the possibility of mistakes in the issuance of land rights certificates.
