Abstract

As an implementation of Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA), the government issued Law Number 56 Prp of 1960 concerning Determination of Agricultural Land Areas with the Implementation of Government Regulation Number 224 of 1961 concerning Implementation of Land Distribution and Compensation , in Article 3 paragraph (1) PP No. 224 of 1961 jo. Article 1 PP No. 41/1964 regulates the prohibition of absentee/guntai land ownership, which states that ownership of agricultural land by people who live outside the subdistrict where the land is located is prohibited, namely so that farmers can be active and effective in working on their agricultural land, so that productivity can be optimized. The purpose of this study was to determine whether the implementation of the abstentee/guntai prohibition of agricultural land ownership in Kupang City, NTT had been carried out properly and what factors were the causes of absentee ownership of agricultural land. The conclusion obtained in this study is that the Kupang City BPN will conduct an Inventory of Ownership of Land Use and Utilization (IP4T), and will conduct socialization to the Regional Government, Notaries and PPAT on PP 41 of 1964, especially article 3d which explains the prohibition of absentee ownership of agricultural land. And what is a factor in absentee ownership of agricultural land is the lack of public knowledge of this prohibition.
