Abstract

Natural resources in Indonesia can be said to be very abundant. Based on Article 33 paragraph (1) of the 1945 Constitution of the Republic of Indonesia shows that natural resources in Indonesia must be optimized. One of the natural potentials that are being optimized and implemented in West Kalimantan Province is the kratom plant. In 2017 the National Narcotics Agency provided information on the results of research on kratom, namely recommending to include kratom as group I. Information about kratom containing narcotics has created a polemic against kratom and creates legal uncertainty in developing the kratom trade. Researchers do research arrangement of kratom trading business licenses in West Kalimantan Province. This type of research uses normative legal research, namely research on the rule of law. The results of the study, namely based on literature studies and the opinions of informants, explained that until 2021 there were no laws and regulations related to kratom in West Kalimantan Province, therefore kratom trading business permits were not implemented in West Kalimantan Province. The urgency of setting up a kratom trade business permit in West Kalimantan Province is important because the community needs a kratom business license arrangement to ensure public safety while still being able to provide sufficient space for the development of regional potential through kratom trade.
