Abstract

Water is a gift from God Almighty that is given to all living things, especially humans for their survival. Water is an object that has a very high economic value, therefore it is not surprising that many business actors, both government and private, make it a staple in business activities. One of them is the Bottled Drinking Water (AMDK) business. However, in practice, often the commercialization of water that is carried out does not guarantee human rights, especially Article 28H which regulates the fulfillment and provision of public facilities and health facilities and economic principles based on the constitution. Based on this explanation, the authors write with the type of normative legal research and obtain primary data sources in the form of legislation and secondary data sources, namely library studies and interviews with resource persons, namely the Head of the Cleo Pure Water Depot Cilacap and the Reverse Osmosis (RO) Staff of the Water Company. Drinking Area Tirta Wijaya Cilacap. The results of the research that the author has done are that commercialization is an economic activity that is often seen as an activity that has negative implications for the public interest carried out by business actors, in this case, bottled drinking water business actors. AMDK business actors in commercializing drinking water must be based on the public interest, in accordance with economic principles and guaranteeing the fulfillment of human rights, especially Article 28H of the 1945 Constitution of the Republic of Indonesia.
