Abstract
Banks in providing credit require collateral as collateral for debt repayment. In practice, not all grants of collateral are encumbered with mortgage rights. If the debtor defaults, the bank will sell the collateral object to pay off the debt. In the execution of mortgages, many obstacles were encountered so that the execution could not run smoothly. This thesis discusses the procedure for imposing mortgage rights at PT BPR ADIPURA SANTOSA Magelang Branch in accordance with the provisions of Law No. 4 of 1996 and the obstacles and efforts to resolve the execution of mortgage rights at PT BPR ADIPURA SANTOSA Magelang Branch. The research method in writing this thesis uses empirical legal research methods. Primary data in this study were obtained directly from respondents and sources. While secondary data obtained through literature study. The conclusion of this thesis is that the procedure for imposing mortgage rights at PT BPR ADIPURA SANTOSA Magelang Branch is not in accordance with the provisions of Law Number 4 of 1996 because it looks at the size of the debt value and sees whether the debtor is in default or not.The obstacles that occur in the implementation of mortgage execution are debtors are not satisfied with limit value, abolition of land rights, difficulty in getting bidders, lawsuits from debtors/third parties, mobilization of mass by debtors, debtors not wanting to vacate the object of execution, and the object of execution being outside the bank's working area.
