Abstract

The title of this research is the responsibility of children in traffic accidents that cause the victim to die.. The background of the problem is that motorized vehicles are often used by the community as access to land transportation that is easy and affordable for other communities, one of which is children who are not yet 17 (seventeen) years old and do not yet have a driving license (SIM) that can be used. cause traffic accidents and even death.The formulation of the problem in this legal research is the responsibility of the child in a traffic accident until the victim dies and what considerations are used by the judge in the decision of the child.The purpose of this study was to determine and analyze the responsibility of children in traffic accidents that resulted in the victim's death and the judge's consideration in decisions relating to cases of traffic accidents that resulted in the victim's death.This study uses a normative method that focuses on positive legal norms. The purpose of punishment for child perpetrators is to get a deterrent effect for the actions they have committed. The decision handed down by the judge provides supervision of the child by the child's parents and the provision of guidance by the community counselor for ten months.the decision is in accordance with the applicable law, namely providing guidance to children by parents and community counselors and the judge's decision using the law on the juvenile justice system.
