Abstract
Legal Memorandum with the title "Alleged Crime of Defamation on Social Media in the Perspective of Freedom of Expression (The Case of Haris Azhar and Fatia Maulidyanti Against Luhut Binsar Pandjaitan". Which explains the alleged criminal act of Defamation which started from a video originating from the Youtube channel "HARIS AZHAR" with the title "There is Lord Luhut behind Intan Jaya's Economic Relations-Military Post!! General BIN is also there" on Friday, September 20, 2021 which the duration is 26.51 minutes. The legal writing of this Legal Memorandum is based on normative legal research by exploring laws and regulations, legal theories, conceptual approaches, and case approaches using deductive thinking. The results of the Legal Memorandum are found that there are no criminal acts of Defamation due to Article 45 paragraph (3) jo. Article 27 Paragraph (3) of Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 concerning Electronic Information and Transactions, answered the next subpoena with data based on a quick riset that had been made and asked Luhut Binsar Pandjaitan for comparative data as a form of mutual clarification, settlement through mediation is a top priority in resolving defamation cases, penal mediation is not yet a form of restorative justice.
