Abstract

This legal writing is concerning on the role of working association in solving up the firing issue by the cases on how is the role of working association in giving the protection toward the worker/ labour if has been legalized the firing issue disconnecting from the part of the employer and why the position of the working association is weak toward the employer. The purpose of this research was to know the role of the working association and to know why the position of working association is weak to the employer. The method of research used in this research was empirical legal research by conduct survey to the object understudied as the primary data and the data sources to complete the result of this reseacrh, either primary data of which included the respondent and also secondary data of which has been collected from library study such as the legislation or the other regulations relating to this research and also the legal literatures that give explanation toward the primary data. The result of this study has been revealed i.e. the role of working association in giving protection toward the worker/ labour in principal perceive on the current cases initially, seeks to conduct the negotiation with the employer by the hope to produce any good agreement to both parties. The position of working association is weak toward the employer because the working association feels afraid by the higher position of other employer, by the reason of they feel if it has been disconnected from the organization, thus the working association feels very dependent toward the employer. Thus, the advice could be given related to this legal writing is the part of employer better to be posited themselves above the working association considering the collective working contract, the position of the employer with the worker/ labour is equalised
