Abstract

The anticipation of penintiary brand forgery. The brand that has known by costumers as a sign of high quality products will accelerate selling process of that product. It's mean that the producer will have high benefit. It can not be denied that the development of high technology will bring positive and negative effect. The production of high quality products is one of the positive effects. While, the negative effects is forgery of products, service and brand. Generally, to gain a big benefit, the producer of product will choose the short cut with used costumers willingness to one product and service by forge that product and service. Of course this benefit will be gain by producers in short time without long process and in low cost, e.g. promotion and publication cost. The method used in this law paper is normative law research. This kind of this research is focus on existed law norms. Normative research has been done by doing some research in theoretical resources as a secondary data, and conduct law research in order to test the existing positive law, and of course that has related with brand forgery. In normative law research, secondary data used as primary data. As this research is law normative research, the analysis used in this research is qualitative research. The brand of product that has generally known by costumers will give benefit to costumers themselves. The forgeries of brand are star from here. The real owner of the brand and costumers are two parties who will have negative effect here. The owner of the brand will lose their benefit potential, decrease their brand image if the forgeries of the product are in low quality. The forgeries of the brand are happen in many ways. One of them is by produce or using the same brand for the same product. The forgery of another people's registered brand will raise misunderstanding in society or costumers especially if it was in the same product.
